How Is A Product Defective?

Product defects are generally put into three categories: design defects, manufacturing defects, and
marketing defects. Design defects are, in a manner of speaking, intended. This type of defect is
inherent in the design of the product and may be a flaw in the construction plan of the merchandise.
Manufacturing defects on the other hand, are defects that were not intended, but were errors in the
item’s fabrication. Marketing defects are faults in the manner that a product is sold. This type of defect
includes inadequate warnings and instructions regarding the use of the product.

Who Is Responsible For A Defective Product?

Most of the products we buy and use are safe. However, some are carelessly made or improperly
designed. Poorly designed or manufactured products can be dangerous and can cause serious injury

Liability for a product refers to a manufacturer or seller is
responsibility for placing a defective product into the hands of
a consumer. “Product” has been very broadly defined to
include most consumer products, from pharmeutical drugs to

manufacturer, a manufacturer of component parts, the
wholesaler, a distributor, and even the retail store that sold the
product to the end consumer.
